Use of our website

You must only use our website for lawful purposes, and you must not use it in a way that infringes the rights of anyone else or that restricts or inhibits anyone else's enjoyment of our website. If you are purchasing on behalf of a business then you must have the required authority to do so.

Boux Avenue Limited shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials used in our website. All rights, including copyright, in our website are owned or licensed to Boux Avenue Limited.

If you love our website, you may use, download and print our content solely for your own personal use or internal business purposes. Other than for these purposes you may not without our prior written consent;

  • Copy, reproduce, use or otherwise deal with any content on our website;

  • Modify, distribute or re-post any content on the website for any purpose;

  • Reproduce, crawl, frame, link to or deep-link into this website on or from any other website.

Description of our products

We are dedicated to providing you with up-to-date and accurate product information so that you get a great sense and feel for our products.

Although we aim to keep the product information as up to date as possible, it may be the case that at the point that the order is placed, some element of the product information may not exactly reflect the details of the actual product:

  • The product packaging may vary from the product images on our website.

  • While we try to show the accurate colour of the product on our website, differences in computer screens and monitors may mean the actual colour of the product that you receive will differ slightly from how you see it on our website. NB - Colour swatches on the product details page are used as a guide to change product colours and do not represent the actual or implied colour of the products.

  • The stock position of the product as shown on the website is a guide only and the available stock position will only be confirmed at the point that the order is accepted.

In any circumstance where the actual product information varies from that displayed on our website, we reserve the right not to accept the order.

Our product pricing

Boux Avenue is a multi-channel retailer and operates a best practice pricing strategy that attempts to ensure the consistency of pricing between all its sales channels.

However, it may be the case that a product or promotion that is available in one sales channel is not always available in all other sales channels. The full price of the order will include VAT plus any additional delivery costs where applicable.

Purchasing our beautiful products

Placing an order on the Boux Avenue website does not mean there is a contract between you and us. The order is only confirmed once we have notified you that the order has been invoiced and despatched.

For the avoidance of doubt, any such contract between you and Boux Avenue will be deemed to have been concluded in the United Kingdom. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England, and you and Boux Avenue Limited irrevocably agree to submit to the exclusive jurisdiction of the English Courts.

The straightforward order process is as follows:

  • Products in our main warehouse are collected by UK Mail and sent for dispatch according to our delivery options.

  • Clicking on the 'Pay now' button in the payment screen of the checkout will submit the order for payment using your chosen payment provider.

  • Once you see the order confirmation page, you will then receive an email confirming the details of each product in your order. This is not a confirmation that the order has been accepted or processed but simply that you have finished the order process.

  • Once the goods are picked, packed and ready for dispatch, we will then process the payment and notify you with an email confirming that the order has been processed. A contract between you and us is in place at this point.

If for any reason, there is a problem in processing the order then we will notify you via email or telephone with the reason it could not be fulfilled. This could be for one of the following reasons:

  1. There was an error in how the product was described or priced on our website

  2. One of the products in the order is currently out of stock

  3. We are unable to take full payment for your order

  4. You did not fulfil your obligations as set out under these terms and conditions

Returns and cancelling your order

Payment for your order will not be taken up until your order has been shipped. You can cancel your order by contacting our customer service team. If you cancel your order after it has been packaged and dispatched from the Boux Avenue warehouse, your order will be delivered to the delivery address provided but can be cancelled and returned to us by following the instructions on our refunds and exchanges page.

Please note that where all or part of an order/purchase containing a promotional discount is refunded or cancelled, the refund will be the total due less the discount given. Where all or part of an order/purchase containing a free item is refunded or cancelled, if the free item is not also returned then the refund will be the total due less the value of the free item.

Methods of payment

We have a variety of payment methods for you to choose from. Please see our Privacy Policy for information about how we manage your payment data. Payment methods are:

  • Debit or credit card. We accept all major debit and credit cards.

  • Paypal

  • Klarna

  • Gift card - see below

All purchases are subject to the usual validation checks and authorisation procedures in place at your chosen payment provider. Any refusal by the payment provider to authorise the payment to us, for any reason, will not render Boux Avenue liable for any delay or non-delivery.

Boux Avenue gift cards

Boux Avenue gift cards can be exchanged for our beautiful products in all Boux Avenue stores, and can be used as full or part payment on our UK website and over the telephone with our customer service team on 0333 103 6550.

The full terms and conditions for our fabulous gift cards are as follows;

  • Your fabulous gift card can be used in full or part payment against all beautiful purchases at Boux Avenue stores and www.bouxavenue.com for UK orders.

  • The total value of your beautiful purchases will be deducted from the balance of your gift card until it reaches zero.

  • You can add value to your gift card in-store from a minimum shopping credit of £5 up to a total maximum of £250.

  • Your gift card will automatically expire 24 months after the last time you use it to make a purchase or top up the value.

  • Boux Avenue does not accept responsibility for your gift card if it is lost, stolen or damaged.

  • Your gift card remains the property of Boux Avenue Limited and is not a cheque guarantee, credit or charge card. It is not for resale and cannot be exchanged for cash or refunded.

  • For our refund policy please see www.bouxavenue.com/customer-services/delivery-and-returns.

  • If you find a gift card please cut in two and return to Boux Avenue Limited, 3rd Floor, 1 St George's Road, Wimbledon, SW19 4DR.

Boux Avenue VIP loyalty scheme and card

The following Terms and Conditions (the “Terms”) together with the Boux Avenue website terms and conditions and the privacy policy apply to the issue and use of the Boux Avenue VIP Card (“VIP Card”, “Card”) promoted and operated by Boux Avenue Limited (“Boux Avenue”).

  1. Becoming a VIP loyalty customer entitles you to use the VIP Card at any UK Boux Avenue store and online at www.bouxavenue.com. Applying for, or using, a VIP Card will constitute acceptance of these Terms. You should therefore read them carefully.

  2. You can apply for a VIP Card free of charge at any Boux Avenue store and online at www.bouxavenue.com. Any change in your postal or email address should be notified to Boux Avenue either online or by contacting our customer services team. VIPs must be individuals, resident in the UK and be 16 years of age or older.

  3. VIP Cards remain the property of Boux Avenue Limited, 3rd Floor, 1 St George's Road, Wimbledon, SW19 4DR. Registered in England, Company number 7191520. VIP Cards should be destroyed or returned to Boux Avenue when no longer valid for use.

  4. The VIP Card is a promotional loyalty card and not a cheque guarantee card, debit card or credit card. You cannot transfer your VIP Card or any of the points credited to it to any other person. The Card is only for personal use.

  5. VIPs will accumulate points when they make qualifying Boux Avenue purchases. One point is earned for every £1 spent in any Boux Avenue store or online and can be used at any time on your future Boux Avenue purchases, for example, 100 points will earn you £3, subject to the terms set out below or in the terms relating to any promotions and offers operated by Boux Avenue from time to time and may not be earned, held, transferred or otherwise traded in any other way.

  6. The number of points earned from a qualifying purchase may vary from time to time at Boux Avenue’s sole discretion.

  7. Points cannot be earned when purchasing gift cards/vouchers.

  8. The following terms shall apply to the use of the VIP Card:

    • The points credited to the VIP Card may be redeemed as part or in full payment for qualifying purchases in Boux Avenue stores and online. If the product purchased is valued less than the points credited to the Card, then the remaining points balance will be retained on the Card and can be used for future transactions.

    • Only one VIP Card can be used per transaction.

    • The VIP scheme is not available on orders outside of the UK

    • Any refund of items purchased using VIP Cards will be made by crediting the applicable amount back on a Boux Avenue Gift Card.

    • The balance held on the VIP Card may not be redeemed for cash under any circumstances.

    • Any points credited to the Card are personal to the individual VIP Card and cannot be transferred or combined with another account to redeem a reward.

    • Members will receive regular email updates of their points balance on their Card. This information will also be available to VIPs online at www.bouxavenue.com/vip or by calling the Customer Service number online. Boux Avenue may correct a balance if it is shown to Boux Avenue’s reasonable satisfaction to be incorrect. In such cases, Boux Avenue’s decision will be final.

    • From time to time VIPs may also earn additional point awards or benefits offered by Boux Avenue at its sole discretion and any such awards or benefits may be subject to additional terms and conditions, which, if applicable will be notified to VIPs in correspondence and/or in store at the time of the award/offer.

    • Boux Avenue accepts no liability for any lost VIP Card which is the responsibility of the VIP to keep safe. If a VIP loses their Card, any points accumulated on the Card will be deemed to be lost unless the VIP contacts Boux Avenue as soon as the VIP becomes aware of the loss. The balance may be transferred to a new Card at Boux Avenue’s sole discretion.

    • By registering for a Boux Avenue VIP Card you will receive emails containing your card balance, promotional offers, competitions and the latest Boux Avenue news and events. There is a link at the bottom of each and every email that we send to you that allows you to easily opt out of receiving further marketing emails. Whilst you remain opted in for such communications, Boux Avenue will review your purchase history to provide you with relevant offers and information based on your preferred products. Boux Avenue will only process your data in accordance with the Boux Avenue website terms and conditions and Privacy Policy.

    • These Terms may be changed at any time at the sole discretion of Boux Avenue and VIPs will be deemed to have accepted the updated Terms each time they go online at www.bouxavenue.com/vip, or when they use their VIP Card. As such you are strongly encouraged to review these Terms from time to time.

    • Boux Avenue may suspend or terminate the VIP Card scheme at any time at its sole discretion. In such event the VIP will be notified. Boux Avenue reserves the right to cancel any VIP Card which has not been used for a period of 24 months at which time you will be notified of the proposed cancellation and any unused points on the Card will be lost.

    • You may cancel your VIP membership at any time by contacting Customer Services or online at www.bouxavenue.com/vip.

    • The limit of Boux Avenue’s liability under these Terms will be exclusively to a VIP who suffers a direct loss as a result of Boux Avenue’s breach of these Terms and in those circumstances Boux Avenue’s sole liability will be to credit the VIP’s card with any points which has been wrongly deducted or which should have been credited to the Card.

    • These Terms and any dispute, claim, or non-contractual obligations arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the law of England, and you irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter.

Terms of Service - Text (SMS) via Wunderkind

If you elect to receive marketing and support text messages from us, either via our website or by sending a text message indicating your consent, you are providing (and signing) your prior express written consent to receive recurring marketing or promotional and support text messages from us (each, a “Text Message”) sent through an automatic telephone dialing system. These may include basket abandon messages. Message frequency varies. This service is optional, and your consent is not a condition for purchase.

You can opt out of receiving any further Text Messages from this program at any time by replying “STOP” to any Text Message you receive from us.

In addition to any fee of which you are notified, your mobile provider’s message and data rates may apply to our confirmation Text Message and all subsequent Text Message correspondence according to your individual rate plan provided by your wireless network provider. Please consult your mobile service network provider’s pricing plan to determine the charges for browsing data and sending and receiving Text Messages.

Under no circumstances will we or our affiliates be responsible for any Text messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number.

If your network provider does not permit Text messages, you may not receive the Text Messages. Neither we nor the wireless network provider will be liable for any delays in the receipt of, or failure to deliver, any Text Messages, as delivery is subject to effective transmission from your network operator.

Text Message services are provided on an “AS IS” basis (as and when it is needed to be sent). Data obtained from you in connection with any Text Message services may include your mobile phone number, your provider’s name and the date, time and content of your text messages.

We may use this information in accordance with our Privacy Policy to contact you and to provide the services you request from us. For more information on how we use telephone numbers, please read our Privacy Policy.

Privacy & security policy

At Bouxavenue.com we absolutely recognise how important it is to keep your personal information safe and secure. Please see our Privacy Policy which explains the information we process about you, how we manage your information and the rights you have. If you have created an account with us, you are responsible for maintaining the confidentiality of your password and for any activities that occur under your account. Boux Avenue shall not be liable for any loss or damage which may arise as a result of any failure by you to protect your password or account.



Limitation of liability

To the fullest extent as permitted by law, Boux Avenue Limited is providing this website and its contents on an "as is" basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this website or the information, contents, materials or products included in this website including, but without limitation, warranties of merchantability and fitness for a particular purpose.

Nothing in these terms and conditions affects your statutory rights.

All disclaimers and exclusions included in these terms and conditions shall be governed by and construed in accordance with English Law. Should any provision of these disclaimers and exclusions be deemed to be unlawful, void or for any other reason unenforceable, then that provision will be deemed to be severable and shall not affect the validity and enforceability of the remaining provisions.
